Job Description

Role:  CONTRACTS & COMMERCIAL MANAGER

Location: Saudi Arabia

Duration: 1 year renewable contract for up to 3yrs

Precontract:

  • Working as part of the Bid Teamto undertake contract reviews and risk analysis for all bids being processed for the respective country.
  • Review, draft, and negotiate contracts with clients, subcontractors, and suppliers.
  • Ensure all contractual obligations are met and that the company is compliant with legal and regulatory requirements.
  • Develop and implement contract management procedures and policies.
  • Preparation and review of Joint Venture Agreements, Consortium Agreements, Joint Bid Agreements, and Non-Disclosure Agreements.

Post contract:

  • Provide commercial and contractual support to project teams throughout the project lifecycle. Lead and manage the commercial and contracts team, ensuring effective collaboration and performance.
  • Monitor project performance and ensure adherence to contract terms and conditions.
  • Resolve disputes and claims related to contractual issues.
  • Ensure that the contract deliverables are met regarding bonds, guarantees, and warranties, and ensure adherence to the contract.
  • Ensure that all monthly Interim Payment Applications are submitted on time and obtain certification in coordination with the Employer's Representative / Engineer.
  • Provide training and mentorship to team members on contractual and commercial matters.
  • Oversee budget preparation and cost control measures to ensure projects are delivered within budget.
  • Monitor cash flow and ensure timely invoicing and payments.
  • Analyze financial data to improve profitability and cost efficiency.
  • Ensure that the Final Account(s) on the project(s) are served and paid on time.
  • Maintain the Provisional Sums, PC Sums, and Daywork Accounts.
  • Maintain the Variation Log and ensure that all Variations and Claims are submitted in accordance with the Contract and presented in the Monthly Application for Payment.
  • Subcontracts: Review SC proposals, evaluate, and finalize the Subcontract Agreement/W.O. in coordination with the Procurement Department. Review and approve the Subcontractors Application(s) for Payment. Ensure that all subcontracts are closed without any claims against us.
  • Manage Contract Close-Out and discharge of the project(s).
  • Ensure all site management staff are aware of and oriented on the contractual obligations of the project, either with the Employer or with the Subcontractors.
  • Ensure proactive contract administration and effective claim management by ensuring that all contractual Notices are served on time and all contractual claims are recovered.
  • Respond to all contractual correspondence to support the project(s)entitlements.
  • Ensure the timely submission of Cost claims and Extension of Time (EOT) claims, including prolongation costs, in coordination with the Planning department.
  • Ensure that all records are maintained to support potential disputes.
  • Provide necessary support in terms of contractual and arbitration matters to the projects involved in either arbitration or litigation.
  • Ensure that any formal disputes that arise are immediately reported to the Country Manager and Senior Director of Commercial & Contracts for discussion and strategy.
  • Advise management on the Alternative Dispute Resolution (ADR) mechanism when a dispute arises between parties (either with the Client or Subcontractor), before proceeding with arbitration or litigation as per the contract/law

Must have: 

    • RICS certified
    • Relevant degree 
    • Experience managing FIDIC contracts on mega projects.
    • Projects with a value of over $500million (2 billion SAR)
    • Middle East project exp.
